The e-commerce website of www.compostbag.eu , a domain name of The Compost Bag Company NV with its registered office at Tildonksesteenweg 171, 3020 Herent VAT BE 0444744208 RPR Leuven, (hereinafter referred to as “compostbag.eu”) offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions (“Conditions”) apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order on the compostbag.eu’s webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by compostbag.eu.
All prices stated are expressed in EURO.
On our Webshop for Households we always include VAT and all other duties or taxes to be borne by the Customer.
On our Webshop for Professionals we always exclude VAT and all other duties or taxes to be borne by the Professional.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes only and may contain elements not included in the price.
Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind compostbag.eu. As regards the accuracy and completeness of the information offered, Compostbag.eu is only bound by an obligation of means. Compostbag.eu is under no circumstances liable in the event of manifest material errors, misprints or printing errors.
If the Customer has specific questions about e.g. types of bags and foils, availability, delivery date or delivery method, we request the Customer to contact our customer service department in advance.
The offer is always valid while stocks last and can be amended or withdrawn by compostbag.eu at any time. Compostbag.eu cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this is explicitly stated in the offer.
The Customer has the choice between the following payment methods:
- Credit card
- Bank card
Compostbag.eu is entitled to refuse an order pursuant to a serious fault of the Customer in relation to orders involving the Customer.
It is not possible to obtain a sales invoice on the e-commerce website of www.compostbag.eu.
Items ordered on the Professional Webshop are delivered in Belgium, the Netherlands and France. Different administrative and delivery costs apply per country.
Items ordered on the Household Webshop are only delivered in Belgium.
Delivery is made by DPD.
Unless expressly agreed otherwise, the goods will be delivered to the Customer’s place of residence within 30 days of receipt of the order.
Any visible damage and/or qualitative deficiency of an item or other shortcoming in delivery must be reported by the Customer to compostbag.eu without delay.
The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by compostbag.eu.
If the Customer is located outside Belgium and wishes to purchase products from compostbag.eu, they can always contact our customer service department at webshop@compostbag.eu.
The delivered items remain the exclusive property of compostbag.eu until paid for in full by the Customer.
The Customer undertakes, if necessary, to inform third parties of compostbag.eu’s retention of title, e.g. to anyone who might come to seize items which have not yet been paid for in full.
The provisions of this article apply only to Customers who purchase items online from compostbag.eu in their capacity as consumers.
The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day:
“on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good”;
“on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last good.”;
“on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the last consignment or part.”;
“on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the first good.”.
To exercise the right of withdrawal, the Customer must inform The Compost Bag Company NV with registered office at Tildonksesteenweg 171, 3020 Herent, webshop@compostbag.eu, 016 270 270 of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.
To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to The Compost Bag Company NV, Tildonksesteenweg 171, 3020 Herent, without delay and in any event no later than 14 calendar days from the day on which he communicates his decision to withdraw from the contract to The Compost Bag Company NV. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods shall be borne by the Customer.
If the returned product is somehow reduced in value, compostbag.eu reserves the right to hold the Customer liable and claim compensation for any reduction in the value of the goods resulting from the Customer’s use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Only items in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase may be taken back.
If the Customer revokes the agreement, The Compost Bag Company NV will refund all payments received from the Customer up to that point, including standard delivery costs, to the Customer within a maximum of 14 calendar days after The Compost Bag Company NV has been informed of the Customer’s decision to revoke the agreement. In the case of sales contracts, The Compost Bag Company NV may wait with the refund until it has received all the goods back, or until the Customer has proved that he has returned the goods, whichever comes first.
Any additional costs resulting from the Customer’s choice of a mode of delivery other than the cheapest standard delivery offered by The Compost Bag Company NV shall not be refunded.
The Compost Bag Company NV will refund the Customer using the same means of payment as the Customer used to carry out the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refund.
Under the Act of 21 September 2004 on consumer protection in the sale of consumer goods, the Customer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer’s home, the Customer must contact compostbag.eu customer service and return the item to The Compost Bag Company NV at the Customer’s expense.
Upon discovery of a defect, the Customer must inform The Compost Bag Company NV as soon as possible. In any case, any defect must be reported within a period of 2 months after its detection by the Customer. Thereafter, any right to repair or replacement lapses.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.
Compostbag.eu products are degradable in nature. Therefore, the products must be used within 12 months of the production date, as also stated on the packaging.

Without prejudice to the exercise of other rights available to compostbag.eu, in the event of non-payment or late payment, the Client shall be liable, ipso jure and without formal notice of default, to pay interest of 10% per annum on the unpaid amount. In addition, Customer shall be liable, ipso jure and without warning, to pay a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, compostbag.eu reserves the right to take back items which have not been paid for (in full).

The personal data communicated by you will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.
You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to The Compost Bag Company NV, Tildonksesteenweg 171, 3020 Herent, webshop@compostbag.eu. If necessary, you can also ask to correct any data that might be incorrect, incomplete or irrelevant.

The personal data obtained may be passed on to a company cooperating with us: YUNGO BV our marketing agency responsible for our communications & DCS our marketing automatisation agence. They will treat this information confidentially.
The customer himself is responsible for keeping his login data and password confidential. Your password is stored encrypted, so The Compost Bag Company NV has no access to your password.
The Compost Bag Company NV keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by compostbag.eu to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.
These Conditions are supplemented by other conditions explicitly referred to, and the general terms and conditions of sale of compostbag.eu. In case of contradiction, these Terms prevail.
The Customer accepts that electronic communications and backups may serve as evidence.
Belgian law applies, with the exception of the provisions of international private law on applicable law.
The courts of the Customer’s place of residence have jurisdiction in the event of legal disputes. The Customer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
